General Terms and Conditions (GTC)
1. Scope
1.1 These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB) via our online shop [Schweighöfer Tortechnik].
1.2 Consumers within the meaning of these Terms and Conditions are natural persons who conclude a legal transaction for purposes that cannot be attributed predominantly to their commercial or independent professional activity. Entrepreneurs within the meaning of these Terms and Conditions are natural or legal persons or partnerships with legal capacity who, when concluding a legal transaction, act in the exercise of their commercial or independent professional activity.
1.3 Any conflicting or deviating general terms and conditions of the entrepreneur shall not become part of the contract unless we expressly agree to their validity in writing.
2. Contracting parties, conclusion of contract, correction options
2.1 The purchase contract is concluded with [Schweighöfer Tortechnik].
2.2 The presentation of the products in our online shop does not constitute a legally binding offer, but rather an invitation to order. By clicking the order button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after the order has been sent and does not constitute acceptance of the contract.
2.3 We may accept your order by sending an order confirmation by email or by delivering the goods within 5 days.
2.4 You can change your entries at any time before submitting the order using the correction tools provided in the ordering process.
3. Contract language, contract text storage
3.1 The languages available for concluding the contract are German and English.
3.2 We do not save the contract text. We will send you the order details and the general terms and conditions by email. After the order has been completed, the data is no longer accessible via the Internet for security reasons.
4. Prices and shipping costs
4.1 All prices include VAT plus shipping costs.
4.2 The shipping costs will be displayed to you during the ordering process and are to be borne by you unless free shipping has been agreed.
4.3 For deliveries to non-EU countries, additional customs duties, taxes and fees may apply, which must be borne by the customer.
5. Delivery and Shipping
5.1 We deliver within Germany, Austria and Luxembourg (excluding islands).
5.2 Delivery times vary depending on the product and destination. An overview of delivery times and shipping costs can be found on our shipping information page.
5.3 Delivery is carried out by a forwarding agent with a truck (18 metres). The customer must ensure that the delivery address is accessible with such a vehicle.
5.4 If delivery by a freight forwarder is not possible, please contact us in advance to clarify an alternative delivery option.
6. Pick up
6.1 You can also collect ordered products personally from our warehouse. Please arrange a collection time for this.
7th payment
7.1 The following payment methods are available in our online shop:

7.3 The goods will be dispatched after receipt of payment. If you choose to pay in advance, the payment deadline is 7 days from the order date. If we have not received the amount after this deadline, we reserve the right to cancel the order.
8. Right of withdrawal
8.1 Consumers have a statutory right of withdrawal as described in our [Cancellation Policy] Cancellation Policy – Tormeister24 .
8.2 Entrepreneurs are not granted a voluntary right of withdrawal.
9. Retention of title
9.1 The goods remain our property until full payment has been made.
9.2 The following also applies to entrepreneurs: We retain title to the goods until all claims from an ongoing business relationship have been settled in full. The resale of the reserved goods is permitted in the ordinary course of business. The entrepreneur assigns all claims arising from this to us in the amount of the invoice amount.
10. Warranty and Liability
10.1 The statutory liability for defects applies.
10.2 For entrepreneurs, the limitation period for claims for defects in newly manufactured items is 12 months from the transfer of risk. The warranty is excluded for used items.
10.3 We shall not be liable to entrepreneurs for slightly negligent breaches of non-essential contractual obligations.
11. Disclaimer
11.1 We are liable without limitation for intent and gross negligence as well as in accordance with the Product Liability Act.
11.2 We are only liable for minor negligence if essential contractual obligations (cardinal obligations) are violated. In these cases, liability is limited to foreseeable, contract-typical damage.
12. Data Protection
12.1 Your personal data will be processed in accordance with our [privacy policy] Privacy Policy – Tormeister24 .
13. Dispute settlement
13.1 The European Commission provides a platform for online dispute resolution (ODR), which you can find at https://ec.europa.eu/consumers/odr .
13.2 We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
14. Final provisions
14.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
14.2 If the customer is an entrepreneur, the exclusive place of jurisdiction for all disputes arising from contractual relationships is our place of business.
